I hereby issue this agreement in favor of BEST803 Boxing, Fitness & Strength Training, duly registered under the RUT of the Ministry of Finance of Costa Rica, operator of the facilities under the BEST803 brand and system, its directors, partners, representatives, shareholders (all hereinafter referred to as "BEST803"), requesting that I be granted use of BEST803's facilities in Paseo Colón, Costa Rica, stating that I have not omitted any information regarding my current health status, including but not limited to: serious back, neck or heart problems, surgeries, epilepsy, episodes of loss of consciousness, pregnancy or breastfeeding, underlying metal prosthetics, infectious diseases, HIV, hepatitis B surface antigen, hepatitis virus antibodies, addiction to or use of steroids, narcotics, psychotropics, or any other drugs. I hereby commit that if I acquire or develop any of these conditions or any other medical problem that may expose myself or other users or third parties to risk, I will notify BEST803 in writing immediately. I accept that if BEST803 requests that I obtain medical insurance or provide proof of said conditions or any other examination, I must complete such within 10 calendar days of the request and deliver a copy of the results to BEST803 immediately upon receipt. I acknowledge that in such cases, it will be at BEST803's discretion to terminate the membership contract without liability.

The member accepts that routines, exercises, practices, as well as physical contact and/or sparring exchanges, whether boxing or any similar discipline carried out at BEST803 facilities, are entirely and absolutely their own responsibility, as they are performed voluntarily. The member commits to engaging only with individuals with whom they mutually agree to do so in a friendly manner. The member acknowledges and accepts that BEST803 does not obligate them to perform any such activities, nor does it impose weight, level, or category requirements. Therefore, BEST803 is not responsible for illnesses, injuries, or disabilities resulting from activities performed and/or pre-existing conditions. The member voluntarily assumes all risks associated with the activity and holds BEST803 harmless from all liability, claims, actions, lawsuits, or demands of any kind arising from any breach of their representations, warranties, or obligations under this agreement.

The member acknowledges and accepts BEST803's internal regulations and agrees that failure to follow instructions or failure to make payments stipulated in the membership contract will result in termination. The member declares awareness of the various risks involved in aerobic, anaerobic, and athletic activities, understanding that risks may range from minor to permanent injuries. The member declares participation on a voluntary basis and assumes full responsibility. The member also acknowledges being physically, mentally, and emotionally fit to enter BEST803 facilities and agrees to pay for any medical care that may become necessary. Furthermore, the member acknowledges that first aid and medical treatment may or may not be provided by BEST803 trained staff in the event of an accident, injury, or illness.


PRIVACY NOTICE AND INFORMED CONSENT

Pursuant to Law No. 8968 "Protection of Personal Data," the member freely, unequivocally, specifically, and informedly authorizes BEST803 to collect and process their personal data in accordance with this authorization and applicable regulations. The member understands and accepts:

a) That BEST803 maintains a personal database for the storage and processing of client personal data.

b) That the purposes for which BEST803 will use said data, and for which it may contact the member, include: enrollment, activity records, security, automatic charges, and all matters related to club activities and physical conditioning, data required for the membership contract and periodic billing, use of BEST803 facilities, member health status regarding illnesses, conditions, and injuries for safety purposes, promotions, services, and general communications about BEST803, information updates, and service quality surveys.

c) That the recipients of personal data, as well as individuals authorized to access it, include BEST803, its collaborators (dependent or independent), advisors (dependent or independent), and authorities.

d) That pursuant to Law No. 8968, the member has the right to request rectification and updating of personal information provided to BEST803. BEST803 administers its database directly and can provide details of stored personal data upon request, as provided by law. Requests must be sent to info@best803.com. In the event of modifications or updates to this privacy notice, BEST803 will notify the member at least 30 days in advance via publication on www.best803.com or by email. If the member is a minor, a parent or legal guardian must sign.


REGULATIONS

1. Membership and Access:BEST803 membership includes access to facilities and classes, varying by package. Hand wraps and gloves are required for boxing, Kids Club, and PILOXING sessions. Reservations are made through the app, valid for 30 days. Classes require a minimum of 2 people and will be cancelled if fewer than 2 are enrolled within 2 hours of the class. Membership is confirmed upon payment of the selected package in the app, followed by a confirmation email. Membership is personal and non-transferable.

2. Hybrid Services:BEST803 offers virtual, in-person, and remote services. Members may access training from home or attend classes at our facilities. Sessions must be reserved through the app or website and payment and identification requirements must be met.

3. Identification and Payment:Identification and payment are required for enrollment. Reservations and classes are managed through our app. Access is denied without a reservation. Accepted payment methods include credit cards (Visa, Mastercard, American Express), bank transfers, and SINPE Móvil. Credit card deposits are only permitted for verified non-residents who must sign a form and provide identification. A unique link is provided upon approval.

4. Pricing:Prices do not include taxes. Please indicate if an electronic invoice is required. Prices and promotions are subject to change — members should check the website regularly.

5. Cancellation and Freeze:Cancellations by the member are not permitted. Only BEST803 may cancel and issue refunds. Membership may be frozen due to medical incapacity. Members must notify BEST803 at least 7 days in advance to cancel.

6. Events:Cancellations by the member are not permitted. Only BEST803 may cancel and issue refunds. All event participants must complete a Know Your Client (KYC) process to ensure the safety of all attendees.

7. Medical Recommendations:Members with specific medical conditions should consult a physician before using the facilities.

8. Conduct:Members must not endanger others. Members are responsible for any damage caused to property or persons.

9. Dress Code:Athletic wear is required. Access will be denied without appropriate clothing.

10. Health Guarantee:Members must be fit for physical activity. BEST803 is not responsible for injuries sustained during sessions.

11. Risks:Physical activities involve inherent risks. Members assume full responsibility for their participation.

12. Loss/Theft:BEST803 is not responsible for loss of or damage to personal belongings.

13. Temporary Closure:Members will be notified of temporary closures via email, WhatsApp, and/or social media.

14. Minors:Children from age 5 are welcome at BEST803. A parent or legal guardian must be present at all times for children under 12 years old. Members 12 and older may attend sessions independently with prior written authorization from a parent or legal guardian on file. For Kids Club sessions, a parent or legal guardian must sign the membership and waiver on behalf of the minor. BEST803 reserves the right to deny access to any minor whose legal guardian is not reachable during the session.

15. Accessories:Long earrings and necklaces are prohibited for safety reasons.

16. Recording and Photography:Recording and photography are prohibited without prior authorization.

17. Lost Items:BEST803 is not responsible for lost or stolen items.

18. Privacy:Pursuant to Law No. 8968 "Protection of Personal Data," the member authorizes BEST803 to collect and process their personal data in accordance with applicable regulations. Requests for data rectification and updates must be directed to info@best803.com.

19. Terms Review:BEST803 may modify terms and conditions. Members will be notified via the website.

20. Health Regulations:Members must comply with Ministry of Health regulations.

21. San José — Appointment Only:The San José location operates by appointment only. Since our coaches work primarily in outdoor training and off-site services, reservations must be paid in advance or personal sessions will not take place. Last-minute visits are permitted with 2 hours notice but must be reserved and paid online and confirmed. Only available classes are visible in the app — you may also verify availability via WhatsApp before booking. Paid session = scheduled session. No payment, no class.

22. Customer Service:A defined process for questions, complaints, and claims is in place. BEST803 will respond within a maximum of 2 business days.
